On May 18, 2023, the U.S. Supreme Court ruled in favor of Williams & Connolly client Lynn Goldsmith in Goldsmith v. Andy Warhol Foundation, holding in a 7-2 decision, following oral argument by Supreme Court and Appellate Litigation chair Lisa Blatt, that the Foundation’s use of a copyrighted photograph was not permitted under the fair use defense to copyright infringement.
