An article by Senior Counsel Paul Mogin, “Justice Scalia and the Interpretation of Criminal Statutes,” appears in the most recent issue of The Champion, the journal of the National Association of Criminal Defense Lawyers. The article examines the late Justice’s efforts to revive the rule of lenity, to reject expansive interpretations of the federal laws prohibiting mail and wire fraud, and to oppose judicial deference to administrative agencies’ interpretations of criminal statutes.
