Chris Manning moderated a panel in August at the ABA Annual Meeting in New York City on “The False Claims Act Post-Escobar.” The panel discussed the Supreme Court’s decision in Universal Health Services v. United States ex rel. Escobar, which has been widely viewed as one of the Court’s most significant decisions regarding the False Claims Act (FCA), and the effects of Escobar in the year since the Court’s decision, including recent lower court rulings, positions taken by the Department of Justice, relators and defense counsel in FCA cases since the decision, issues that remain to be resolved, and issues that have emerged since the decision.
