On September 30, 2025, Williams & Connolly client Genentech prevailed in a major trial against Biogen in a long-running, nine-figure breach of contract case concerning unpaid royalties. In July 2025, the W&C team tried the case to an Oakland jury in the Northern District of California. After the jury deadlocked 7-1 in Genentech’s favor, both sides agreed to let the district court resolve the case on the trial record. And on September 30, the Court entered a lengthy order deciding the case in Genentech’s favor, awarding all of the damages Genentech requested—over $88 million in unpaid royalties, an amount that will increase to over $122 million when pre-judgment interest is included.
Partners Paul Gaffney, Luke McCloud, and Ellen Oberwetter led the trial team along with associates Ricardo Leyva, Emma Nino, George Wang and Kyle Greene.
