On July 7, 2026, Chief Judge Kleeh of the Northern District of West Virigina dismissed key counterclaims and defenses lodged by Amgen against Williams & Connolly client Regeneron Pharmaceuticals in consolidated multi-district BPCIA litigation regarding Regeneron’s market-leading and vision-saving product, Eylea® (aflibercept). After Regeneron sued Amgen over the development of Amgen's biosimilar (Pavblu), Amgen filed antitrust and other counterclaims. Following oral argument from Teagan Gregory, Chief Judge Kleeh largely sided with Regeneron, dismissing Amgen's fraud-based defenses, patent misuse, and federal antitrust counterclaims.
