Published February 1, 2023, Partner John McNichols and Associate Christopher Yeager co-authored the article “Recovering the Costs of Responding to a Nonparty Subpoena” for Reuters Practical Law: The Journal. The article explains the legal principles governing cost-shifting in response to nonparty document subpoenas and provides strategies that nonparty subpoena recipients may be able to use to shift all or a portion of the costs of compliance to the subpoenaing party.
