The American Bar Association published an article in the Spring 2021 edition of Litigation News authored by partner John McNichols titled “Keeping One’s Public Face Private.” The article discusses some of the legal and privacy implications of facial recognition technology, including applications going beyond mere recognition and identification of particular persons. The article also summarizes a recent study where facial recognition algorithms were shown to discern certain personality traits and discusses the resulting potential legal controversies.
