Delaware’s Daubert Standards for Toxic Tort Cases: An Issue of Nationwide Importance

Partner John McNichols has co-authored an article with associate Kyle Thomason and Timothy Houseal of Young Conaway Stargatt & Taylor, titled “Delaware’s Daubert Standards for Toxic Tort Cases: An Issue of Nationwide Importance,” published by Widener University Law School’s Widener Law Review.  The article delves into an aspect of Delaware case law that may be of particular concern to companies whose products, or by-products, may result in toxic tort claims – specifically the Daubert standard for admissibility of expert testimony on scientific or technical issues.  As experienced toxic tort lawyers know, the critical issue of causation can be heavily influenced by expert testimony and thus the success or failure in toxic tort cases boils down to a “battle of the experts.” 

John focuses his practice on trial litigation, with emphasis on mass tort suits, securities and investment disputes, and criminal fraud cases.  He has tried multiple cases in both state and federal court, representing both plaintiffs and defendants.  John has also arbitrated cases before the ICC International Court of Arbitration and the American Arbitration Association.
