Jennifer Wicht is a leader in the firm’s practice representing corporations and individuals in government investigations and False Claims Act (“FCA”) litigation, focusing in particular on the health care industry.  Her clients include pharmaceutical manufacturers, pharmacy benefit managers, hospitals, specialty pharmacies, senior living facilities, and distributors of medical and surgical supplies.  She has tried multiple cases in federal and state courts, in arbitration proceedings, and in appeals.  She Co-Chairs the firm’s FCA and Qui Tam practice as well as its State Attorneys General Investigations practice.

Jennifer also has participated extensively in the firm’s criminal practice.  She has represented individuals and corporations in all aspects of criminal proceedings, from grand jury investigations to post-conviction proceedings.

Jennifer joined the firm in 2000 after graduating magna cum laude from the Georgetown University Law Center and clerking on the U.S. District Court and then the U.S. Court of Appeals for the District of Columbia.  Since her election as partner, she has participated actively in firm management.  She serves as the Chair of the committee charged with evaluating junior associates, and Vice-Chair of the committee that evaluates candidates for partner.  She is a former member of the firm’s Hiring Committee and Summer Associates Committee.

Representative Experience

Though all cases vary and none is predictive, examples of Jennifer’s matters include:

  • Representation of a wholesale distributor in a 3-month bench trial in West Virginia federal court that resulted in complete defense verdict.  The American Lawyer named the team “Litigators of the Week” in recognition of the bellwether victory in one of the most closely watched litigations in the country.
  • Representation of a PBM in a government FCA investigation that resulted in a declination and dismissal. 
  • Representation of a telehealth company in a government FCA investigation that resulted in a declination and dismissal.
  • Multiple victories on motions to dismiss and motions for summary judgment in FCA litigation against companies in the health care industry.
  • Representation of a specialty pharmacy in a wide-ranging state government consumer protection investigation that resulted in no complaint being filed and a settlement for the cost of the investigation.
  • Representation of a medical device distributor in a criminal and civil investigation, in which no criminal charges were brought and civil claims against the firm’s client were dismissed by the government.
