Bayer Prevails in Bench Trial over Validity of Patent Protecting Staxyn Product

Judge Sleet of the U.S. District Court for the District of Delaware recently ruled in favor of Williams & Connolly client Bayer in a bench trial against Watson over the validity of a Bayer patent protecting its erectile dysfunction drug Staxyn.  At the trial itself in April 2015, Judge Sleet previously upheld the validity of two other Bayer patents claiming vardenafil, the active ingredient in Staxyn and Bayer’s product Levitra, ruling from the bench that Bayer’s patent claims were valid.

The trial team for Bayer’s most recent win was led by Dov Grossman and for the compound patents was led by David Berl.
