On June 8, 2022, the U.S. Supreme Court ruled in favor of Erik Egbert, a U.S. Border Patrol agent sued in his individual capacity under the First and Fourth Amendments. The Supreme Court ruled 9-0 for Agent Egbert on the First Amendment claim, holding that the Constitution does not permit implied damages suits for First Amendment retaliation claims. And the Court ruled 6-3 for Agent Egbert on the Fourth Amendment claim, barring such claims in the border-security context. Partner Sarah Harris argued Egbert v.
