Tobin Romero practices in the areas of white-collar criminal defense and civil litigation.

Mr. Romero has defended clients during all stages of the criminal process, including grand jury investigations, trials, and appeals. He has represented corporate executives, public officials, attorneys, and other individuals and entities in matters involving allegations of insider trading, securities fraud, mortgage fraud, accounting fraud, insurance fraud, health care fraud, bank fraud, public corruption, election offenses, money laundering, false claims, and environmental crimes. He has defended these same clients in parallel civil proceedings, including Securities and Exchange Commission enforcement proceedings, Federal Election Commission enforcement proceedings, and Office of Inspector General investigations. Mr. Romero's civil practice focuses on securities, financial services, and complex commercial litigation.

Recent criminal cases

  • Successfully argued for dismissal of false statement charges against former political party representative on the grounds of vindictive prosecution
  • Represented former CEO in securities fraud case in which trial court dismissed indictment because of prosecutorial misconduct
  • Served as trial counsel and successfully argued for judgment of acquittal on behalf of former political party representative in conspiracy prosecution
  • Obtained declination letter on behalf of attorney who was target in securities and insurance fraud investigation
  • Served as trial counsel for former executive in securities fraud case in which the prosecution dismissed all charges after its case collapsed during trial

Recent civil cases

  • Served as lead defense counsel for attorney in SEC investigation of alleged Ponzi scheme in which SEC issued declination letter
  • Served as lead defense counsel for hedge fund in commercial dispute in which trial and appellate courts dismissed complaint
  • Served as lead defense counsel for former executive in SEC investigation of alleged real estate investment scheme in which SEC declined charges against client
  • Served as co-lead defense counsel for entity in civil RICO case in which trial and appellate courts dismissed complaint
