George Borden has broad experience in a wide range of civil, criminal, and appellate litigation, with a particular focus on securities, corporate governance and intellectual property. 

George has defended corporations, professional firms, and individuals in class actions under the securities laws; litigated shareholder derivative suits in numerous jurisdictions; and represented clients in SEC enforcement proceedings.  George's intellectual property work includes the representation of major corporations in patent litigation in the pharmaceutical and biotechnology industries.  He is an adjunct professor of securities litigation at George Washington University Law School and Catholic University Columbus School of Law. 

Born and raised in the Philadelphia area, George received his A.B. in 1984 from Princeton University, where he was editorial chairman of The Daily Princetonian and concentrated in the Woodrow Wilson School of Public and International Affairs.  He received his J.D., magna cum laude, from Harvard Law School, where he was Executive Editor of the Harvard Law Review.  Mr. Borden clerked for Judge Amalya L. Kearse of the U.S. Court of Appeals for the Second Circuit before joining Williams & Connolly in 1988.

In his spare time, Mr. Borden enjoys photography, for which he has won numerous awards, and chess, for which he has won none.

Representative Experience

Though all cases vary and none is predictive, George’s experience includes:

  • Successfully represented the New York Stock Exchange in winning dismissal of class-action litigation related to high-frequency trading, after the publication of Michael Lewis’s book Flash Boys; victory accorded Legal Lion status in Law360
  • Successfully represented major pharmaceutical company in winning dismissal of a securities class action based on statements concerning the results of clinical trials
  • Successfully represented Fortune 100 technology company in shareholder derivative litigation growing out of prior antitrust issues
  • Represented major law firms in securities class actions arising from the collapses of Refco and Enron.
  • Successfully represented underwriter in class action litigation arising out from Hurricane Katrina
  • Successfully represented investment bank in securities class action arising from alleged improper trading in a PIPE transaction
  • Represented Fortune 100 agribusiness company in securities and derivative litigation arising from prior antitrust issues, including Delaware Supreme Court case on the common law duty of disclosure
  • Successfully represented a private equity fund in Section 16 litigation
  • Successfully represented a technology company in a suit relating to improper trading of restricted shares
  • Successfully tried to judgment a personal injury action on behalf of a plaintiff who had suffered a vaccine-related injury
  • Successfully argued multiple appeals in United States Courts of Appeals
  • Participated in the defense at the criminal trial of a world champion athlete
